Program Description
The City of Carbondale provides an optional text message notification service ("Service") to deliver updates, alerts, reminders, emergency information, event notices, and other communications to residents who voluntarily opt into the program.
Participation in the Service is voluntary, and by enrolling, users agree to the Terms of Use and Privacy Notice set forth below.
Terms of Use
Acceptance of Terms
By enrolling in the City's SMS notification service, you ("User") consent to receive text messages from the City at the mobile number you provide. These Terms constitute a binding agreement between the User and the City. If you do not agree, do not enroll.
Frequency of Messages
Message frequency may vary and may include:
- Routine municipal information
- Emergency notifications
- Public safety messages
- Event reminders
- Service disruptions (water, roads, utilities)
- Other City-related communications
The City does not guarantee specific message frequency.
Opt-In and Opt-Out
- Opt-In: Users may subscribeby signing up through the City's website carbondalepa.org
- Opt-Out: Text STOP at any time to unsubscribe.
- Users may also text HELP for assistance.
- Opting out will discontinue all non-emergency messages.
- The City may still contact users for legally required notifications.
Cost and Charges
The City does not charge a fee for this Service.
Standard message and data rates from your mobile carrier may apply.
The City is not responsible for carrier charges.
User Responsibilities
Users agree to:
- Provide accurate and up-to-date mobile numbers
- Maintain ownership/authority over the enrolled number
- Notify the City immediately if the number changes or is reassigned
The City is not liable for messages sent to numbers that have changed without notice.
Service Availability
The City provides this Service "as is".
Delivery of messages is not guaranteed and may depend on:
- Mobile carriers
- Device compatibility
- Network conditions
- Third-party service providers
The City is not responsible for:
- Delays, failures, or undelivered messages
- Service outages or interruptions
- Errors caused by carriers or third-party platforms
Privacy and Data Use Statement
Information Collected
The City may collect:
- Mobile phone number
- Message interaction data (such as delivery confirmations)
- Optional user-submitted information (e.g., name, address, program preferences)
The City does not seek sensitive personal information via SMS.
How Information Is Used
Information is used solely for:
- Delivering the SMS Service
- Improving municipal communications
- Verifying subscription status
- Complying with legal obligations
- The City does not sell or share personal information for marketing purposes.
- Mobile data collected will not be sold
Disclosure of Information
The City may disclose user information:
- As required by federal, state, or local law (including public records laws)
- To authorized service providers supporting the SMS platform
- In emergencies to protect life, safety, or property
Data Security
The City employs commercially reasonable security measures, but:
- No system is 100% secure
- The City cannot guarantee protection against all unauthorized access
Emergency and Public Safety Notifications
SMS messages may include emergency alerts; however:
- Users should not rely solely on SMS for emergency communication
- The City recommends maintaining multiple alert systems (e.g., email, NOAA radio, official apps)
- The City is not liable for failure to deliver emergency messages.
Disclaimer of Warranties
To the fullest extent permitted by law, the City disclaims all warranties, including:
- Accuracy, reliability, or completeness of messages
- Fitness for a particular purpose
- Continuity or availability of the Service
Limitation of Liability
The City is not liable for any:
- Damages arising from delayed or undelivered messages
- Reliance on information sent via the Service
- Losses resulting from technical failures or user error
Amendments
The City may modify these Terms at any time.
Continued use of the Service constitutes acceptance of any updates.
